Terms of Service

1. Agreement to Terms

By installing, accessing, or using the BabbleChart mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not download or use the Service.

2. Medical Disclaimer (Critical Information)

NOT MEDICAL ADVICE:

BabbleChart and all related AI-generated sleep schedules, pediatrician charts, and growth insights are provided for informational and educational tracking purposes only. The Service does not provide medical advice, diagnosis, or treatment. Always seek the advice of your pediatrician or other qualified health provider with any questions you have regarding your child's medical condition or symptoms. Do not disregard professional medical advice or delay seeking it because of information obtained through this Service.

3. Accounts and Co-Caregivers

You must provide accurate account information upon registration. You are responsible for keeping your login credentials secure. When you invite another caregiver to synchronize data with your infant profile, you acknowledge that they will have read/write permissions for all log history. We are not liable for any actions or data deletions performed by caregivers you invite.

4. Subscriptions and Payments

  • Premium Subscriptions & AI Credits: Certain features (such as detailed AI insights and unlimited Voice/Vision AI charting) are available under monthly or annual subscription plans or on-demand AI credit packs billed through Apple App Store (StoreKit) or Google Play Billing.
  • Billing & Renewals: Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours prior. Cancellations must be managed via your respective mobile app store account settings.
  • Refunds: All purchases are handled by Apple and Google. We cannot directly issue refunds for subscriptions or credit packs.

5. User Data and AI Processing

You retain all ownership rights to the logs, voice notes, and images you upload. By uploading content, you grant us a worldwide, non-exclusive license to store and transmit this data for the sole purpose of providing the tracking service and running transcription or vision analysis through our Gemini AI integrations. We process all data in compliance with our Privacy Policy.

6. Prohibited Activities

You agree not to:

  • Reverse engineer or attempt to extract the source code of the mobile client or backend API.
  • Use the application to upload files containing viruses, malicious code, or offensive materials.
  • Attempt to bypass API request limiting or Google Cloud firewall rules.

7. Limitation of Liability

To the maximum extent permitted by law, BabbleChart and its developers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the Service, including but not limited to any decisions you make based on tracking logs or AI recommendations.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page and revise the update date. Your continued use of the application following the posting of changes constitutes acceptance of those changes.
